Unlike the H-1B, which is tied to a specific company, the O-1 offers two distinct filing structures:

A standard sponsor-employee relationship. One company sponsors you for a specific role, you work only for them.
The preferred choice for founders and freelancers. A U.S. agent (individual or company) files on your behalf, acting as a conduit between you and multiple clients or projects.
Agent petitions require a detailed itinerary but allow you to work for multiple employers or your own startup concurrently.

To qualify, you must satisfy at least 3 out of 8 criteria (or have a major one-time award like a Nobel or Oscar):

Awards: Nationally or internationally recognized prizes for excellence.
Memberships: Elite groups requiring outstanding achievements for entry.
Press: Published material about you/your work in major media outlets.
Judging: Serving as a judge (peer-reviewer, hackathon judge, or pitch competition panelist).
Original Contributions: Evidence of major significance in your field (patents, algorithms, or industry-standard products).
Scholarly Articles: Authoring papers in professional journals or trade publications.
Critical Role: Performing an essential function for organizations with a distinguished reputation.
High Salary: Compensation that is significantly higher than peers in your field.

You must obtain a written Advisory Opinion from a peer group, labor union, or management organization. If no union exists for your specific niche, your attorney will secure a No Objection letter from a relevant industry body.
2026 Fee Schedule:
- Premium Processing: $2,965 (effective March 1, 2026) for a decision within 15 business days.
- Visa Integrity Fee: A new $250 fee introduced in 2025/2026, payable upon visa issuance. This fee is refundable after departure or status adjustment, provided all visa terms were met.

Initial stays are granted for up to 3 years.
Extensions can be filed indefinitely. Note that while extensions for the same project are typically granted in 1-year increments, a petition for a new project or a change in petitioner can often secure a fresh 3-year grant.
